TYPOGRAPHICAL ERRORS
OldCubaArt.com has made every effort to ensure the accuracy of the
product information and description. In the event a product is listed
at an incorrect price due to typographical, photographic or technical
error, OldCubaArt.com shall have the right to refuse or cancel any
orders placed for products listed at the incorrect price. OldCubaArt.com
shall have the right to refuse or cancel any such orders whether
or not the order has been confirmed and your credit card charged.
If your credit card has already been charged for the purchase and
your order is cancelled, OldCubaArt.com shall immediately issue
a credit to your credit card account in the amount of the incorrect
price.

2000 COMPLIANCE. OLDCUBAART.COM EXPRESSLY DISCLAIMS ALL WARRANTIES,

APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION
DIRECT, INDIRECT, COMPENSATORY, SPECIAL, INCIDENTAL, PUNITIVE AND
CONSEQUENTIAL DAMAGES.
LIMITATION OF LIABILITY
OLDCUBAART.COM shall not be liable under any circumstances for any
special, consequential, incidental, punitive, or exemplary damages
arising out of or in any way connected with the agreement to sell
product to buyer or the product, including, but not limited to,
damages for lost profits, loss of use, lost data or for any damages
or sums paid by buyer to third parties, even if OLDCUBAART.COM has
been advised of possibility of such damages. The foregoing limitation
of liability shall apply whether any claim is based upon principles
of contract, warranty, negligence or other tort, breach of any statutory
duty, principles of indemnity or contribution, the failure of any
limited or exclusive remedy to achieve its essential purpose, or
otherwise.
JURISDICTION AND VENUE
You agree that any legal action brought against OLDCUBAART.COM shall
be governed by the laws of the State of FLORIDA without regard to
its conflict of law principles. You agree that the sole jurisdiction
and venue for any litigation arising from your use of or orders
made on the OLDCUBAART.COM sites shall be an appropriate federal
or state court located in DADE COUNTY, FLORIDA.
Return Policy
All sales are final. Only defective products can be returned for
replacement or credit at OldCubaArt.com's discretion within thirty
(30) days from the ship date. . All returns must be in the original
box with all packing materials, cables, manuals, accessories, and
UPC code on the box intact. OldCubaArt.com reserves the right to
reject any packages that do not meet any of the above criterias
and/or impose 20% handling fee. If your order arrives damaged, it
is best to REFUSE it back to the carrier attempting delivery. If
you accept the package, make sure carrier's delivery record is noted
regarding the damage, in order for OldCubaArt.com to file a damage
claim. Save the merchandise AND the original box and packing it
arrived in, notify OldCubaArt.com within 24 hours. RMA Number For
all returns, you must obtain an RMA (Return Merchandise Authorization)
number from OldCubaArt.com or no refund or replacement will be issued.
We will not issue credits or replacements for unauthorized returns.
You may request RMA number by calling Customer Service at 305-256-7326.
RMA number and product return instructions will be emailed within
48 hours. The RMA number is necessary to coordinate returns with
our warehouse and accounting departments. Please use a LABEL; DO
NOT WRITE OR MARK THE BOX ITSELF. All returned products must be
in 100% complete condition. Products must be returned with original
packaging that has not been written on or defaced, manuals, blank
warranty cards and other accessories provided by the manufacturer.
Incomplete returns will not be accepted. SHIPPING RETURNS Freight
must be prepaid and insured to our offices. The customer is responsible
for shipping returns to our offices and all the shipping costs.
We ask that shipments to our returns warehouse be sent via UPS,
FedEx or other traceable method so that you may receive a tracking
number to be sure that the shipment does arrive to its destination.
RETURN OPTIONS STANDARD REPLACEMENT - OldCubaArt.com will ship a
replacement upon receipt of the defective product. Note: Standard
Replacement may take (2) two -(3) three weeks turn around time.
EXPRESS REPLACEMENT (Cross Ship) - OldCubaArt.com will ship a replacement
and charge it to credit card. Once the defective product is recieved
back to our warehouse, we will issue a full credit within one (1)
to two (2) weeks of receipt. STANDARD REFUND - Product must be in
the original box with all packing materials, cables, manuals and
accessories intact. A 20% restocking fee may apply to the amount
of the item returned. Shipping and Handling charges are not refundable.
Keep all packing material and documentation intact in case your
product must be returned. Software products may not be returned
if they are open or the product's seal has been broken. * Please
note that some manufacturer's products may be returned only for
replacement. If you have a question about how the Return Policy
